ASIC's pre-hedging consultation closes with pushback from derivatives industry. Submissions on Consultation Paper 389 — ASIC's proposed regulatory guide setting expectations for how market participants engage in pre-hedging ahead of client orders — closed 27 July. ISDA's submission, published the same day, urged ASIC to keep the final guide aligned with IOSCO's pre-hedging recommendations and existing industry codes rather than diverging into a stricter Australian standard, warning that inconsistency could disadvantage local market intermediaries. ASIC has said the guide would not create new legal obligations but would clarify how existing market-integrity and conduct rules apply; a final regulatory guide is expected after submissions are reviewed.
